I Accept the Terms and Conditions - Credit Application Agreement

This document serves as a formal request by the Applicant to JWG Investments LLC, collectively referred to as "Seller," for business credit extensions aimed at deferring payment for the purchase of construction materials. By submitting this application, the Applicant acknowledges that this Credit Application Agreement governs all sales transactions. Seller's affiliates or subsidiaries may act as Collection Agents and are empowered to enforce the terms herein. Specific terms for each sale are outlined in corresponding invoices, which the Applicant agrees to abide by.

Until full settlement of all amounts owed to Seller for supplied materials, for which Applicant receives third-party payment, Applicant must segregate and hold the proceeds in trust for Seller. Seller retains an equitable lien on these funds until payment is received. Applicant grants Seller permission to obtain necessary credit reports and information from any relevant sources, with Seller retaining the right to reinvestigate Applicant's credit as deemed necessary.

Seller reserves the unilateral right to limit or terminate credit extensions to Applicant. Furthermore, Applicant authorizes Seller to serve as a credit reference, responding to inquiries from other creditors or trade associations regarding transactions with Applicant. The undersigned certifies the accuracy and completeness of the information provided, affirming that purchases are solely for business purposes.

Applicant commits to promptly informing Seller of any changes affecting their ability to pay. In case of legal proceedings or collection efforts, Applicant agrees to cover all associated costs, including court fees and attorneys' fees. Seller may modify this agreement with written notice to Applicant at their discretion.

In acknowledgment of Seller extending credit to the Applicant, we, the undersigned individuals, jointly and severally guarantee the fulfillment of any and all future obligations of the aforementioned business to Seller, in accordance with the terms outlined above. By checking this box, each individual provides explicit written consent to the creditor or its designated agents and affiliates, authorizing the review of his or her personal credit profile from a national credit bureau. This authorization encompasses the acquisition of a credit profile for the evaluation of this application, as well as for the purpose of subsequent updates, renewals, or extensions of additional credit from the creditor, and for the review or collection of resulting accounts. We affirm our respective identities as the individuals identified in the preceding application.
